Arbitration in the International Context
0Panel brings together experts from Perú, Panamá, United States of America, Portugal, and Brazil
During the last years, the use of mediation in conflit resolution has evolved and expanded in Brazil. The Arbitration Law No. 9,307 of 1996 was approved at the same time as most arbitration laws in Latin America. However,the real development and exponential growth of this institute in the country started to happen only a few years later. This expansion was more pronounced in 2001, whenn arbitration was declared constitutional by the Federal Supreme Court. This happened as part of a process to ratify a foreign sentence. Likewise, arbitration within the State, which is the main topic of this panel, is growing rapidly.
With the main purpose of understanding how this extrajudicial method of conflict resolution has been used in the public administration not only in Brazil but also in other countries, FECEMA – Santa Catarina Federation of Mediation and Arbitration Entities is promoting the panel entitled: “Dialogues of the MASCS in the international scope – Arbitration with the State in the national and international perspective in the USA, Panama, Peru, Portugal, and Brazil”. This panel is part of the XI SECMASC – Seminar on Conciliation, Mediation and Arbitration of Santa Catarina.
